Terms of Service

[01] Scope of Service

EVOLUM (the "Service") is an online platform for independent film development. It provides tools for screenplay analysis, pitch-deck generation, audition preparation, project rooms, festival tracking, investor deal rooms, and supporter engagement. The Service is owned and operated by Developum AI Engine. By accessing the Service at evolumstudio.com, you agree to these Terms of Service.

[02] Accounts & Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of forming a binding contract to use the Service. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at madbradsmith@gmail.com if you believe your account has been compromised.

[03] Subscriptions, Billing, & Cancellation

Most tool surfaces — Filmmaker Workspace, Pitch Deck Builder, Project Room, Audition tool, Self-Tape Room, Booked Role — require an active subscription. We offer four plan tiers (Solo, Studio, Writer's Room, Production Co.), each on a monthly recurring cycle. All payments are processed by Stripe, our PCI-DSS-compliant payment provider. EVOLUM never sees, stores, or transmits your full card number.

Trial: Each plan includes a 3-day trial. Cancel before the trial ends to avoid being charged.
Cancellation: You may cancel anytime from your billing page. Cancellation takes effect at the end of the current billing period — your tool access stays active until then.
Refunds: Subscriptions are non-refundable for the current billing period once a charge has succeeded. If you believe a charge was made in error, contact madbradsmith@gmail.com and we will review it case by case.
Plan Changes: Upgrades take effect immediately and are pro-rated. Downgrades take effect at the next billing cycle.

[04] Intellectual Property Rights

You retain all rights, title, and interest in the screenplays, treatments, sides, audition footage, and other creative content you upload to the Service. You retain all rights, title, and interest in the pitch decks, analyses, audition prep reports, and other outputs generated for you by the Service.

You represent and warrant that you hold the necessary rights or licenses for all content you upload. EVOLUM is granted a limited, non-exclusive license to process your content solely to operate the Service and produce your outputs — not to publish, distribute, or train on it.

EVOLUM and "Developum AI Engine," along with our trademarks, logos, and the visual design of the platform, are our property. You may not use them without written permission.

[05] Account Deletion & Data Wipe

You can request account deletion and the destruction of all associated project files, generated outputs, audit records, and workspace configurations at any time. Email madbradsmith@gmail.com. We complete the purge within 30 days. Billing records may be retained as required by tax and financial regulations.

[06] Acceptable Use

Your use of the Service is also governed by our Acceptable Use Policy and our House Rules. Violations may result in suspension or termination of your account, without refund for the current billing period.

[07] AI Outputs & Your Responsibility

Many features of the Service are powered by large language models and image-generation models. These models can produce factual errors, miss nuance, fabricate references, or generate output that does not satisfy regional regulatory, legal, or industry requirements. You are responsible for reviewing every output the Service produces for you before submitting, signing, publishing, or distributing it. EVOLUM does not provide legal, financial, tax, or production-budget advice — outputs are creative work product, not professional counsel.

[08] Limitation of Liability

The Service is provided "as is" and "as available." We do not warrant that the Service will be uninterrupted, error-free, or meet your specific requirements. To the maximum extent permitted by law, Developum AI Engine and EVOLUM are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of revenue, profits, data, or goodwill, arising from your use of the Service.

Our total cumulative liability to you for any claim arising out of these Terms or the Service is limited to the amounts you paid us in the twelve (12) months preceding the claim.

[09] Termination by Us

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, the Acceptable Use Policy, or the House Rules, or if your use poses a risk to the Service or to other users.

[10] Changes to These Terms

We may update these Terms periodically. Material changes will be communicated to account-holders by email. Continued use of the Service after a change constitutes acceptance.

[11] Governing Law

These Terms are governed by the laws of the State of Delaware and the United States, without regard to conflict-of-law principles. Any dispute arising under these Terms will be brought exclusively in the state or federal courts located in Delaware.
